ALL PRICES AND AVAILABILITY ARE SUBJECT TO CHANGE WITHOUT NOTICE!

TERMS OF PAYMENT:
We accept cash, Visa, Discover, American Express, Mastercard and company checks with proper identification. A $25 fee will be charged for any returned check. For customers with established good credit, we offer terms of 2% net in 10 days from date of invoice. Late charges of 1.5% per month will be charged on all overdue balances. Any account showing a balance of 60 days or more will be handled on a C.O.D. basis with no discounts allowed. Payments on the balance must be made to continue purchasing material. A 5% Maryland Sales Tax will be charged on all orders within Maryland unless your Maryland Sales Tax number is supplied to us prior to purchase. No other state's exemptions will be accepted.

LIMITED WARRANTY:
We guarantee plant material to be properly identified, properly handled and in good health at the time of sale. We take great pride in growing our nursery stock. We warrant that cultivars will be true-to-name. We will replace nursery stock that is proven to be untrue to name or refund the original amount paid, at our option. THE FORE-GOING WARRANTY IS EXCLUSIVE, AND WE HEREBY DISCLAIM AND EXCLUDE ALL OTHER WARRANTIES, WRITTEN OR ORAL, EXPRESS OR IMPLIED, INCLUDING WITH-OUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. The remedies provided herein are the sole and exclusive remedies available. We shall have no responsibility other then, at our option, to replace nursery stock that is proven to be untrue to name, or to refund the original amount paid. IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OR PROFITS) WHETHER BASED ON CONTRACT, TORT, OR GREATER THAN THE ORIGINAL PURCHASE PRICE, and in the event that any limitation of warranty or disclaimer of liability is found to be unlawful or inapplicable, or to have failed of its essential purpose, our liabilities shall be limited to the amount paid for the specific nursery stock that caused such liability.

SHIPPING:
All prices F.O.B. Monkton, Md. Plants are shipped via UPS unless another method is specified. Shipping charges are prepaid, you will be billed for these charges. All plants become property of the purchaser upon delivery to the carrier. Manor View Farm takes great care packing our plants but cannot be responsible for shipment damage or loss.
